Republicans Move To Ban Pedophiles From Using Surrogacy After Homosexual Abuser Obtained Boy

WASHINGTON, D.C. (LifeSiteNews) – Republican House lawmakers have introduced legislation to stop sexual predators from obtaining children through the use of surrogacy, after a homosexual registered sex offender purchased a baby boy in Pennsylvania.

Last year, LifeSiteNews covered the case of Brandon Mitchell, a Tier 1 sex offender in Pennsylvania, convicted of “sexual abuse of children” and “possession of child pornography.” A high school chemistry teacher at the time, Mitchell was arrested in 2016 for numerous “sexually explicit solicitations and conversations” with a 16-year-old student after he was found to have sent 20 explicit photos and a sexually explicit video of himself. 

Despite this record, Mitchell and his “husband” Logan Riley shared a video of them celebrating holidays with the surrogate-born boy through the first year of his life, enabled by the largely-unregulated surrogacy lacking the basic safeguards found in the adoption process.

Now, U.S. Rep. Rep. Scott Perry (R-PA) has introduced a pair of bills aimed at addressing the situation as well as curbing surrogacy use by foreigners.

HR 9131, the Protecting Kids From Creeps Act, would establish that any surrogacy agency that “knowingly or recklessly facilitates a surrogacy agreement in which a party to that agreement is a sex offender” would be fined and jailed at least 10 years if reckless and 20 years if knowingly. Agencies convicted under the law would also lose their eligibility for tax-exempt status.

HR 9132, the Preventing International Surrogacy Exploitation Act, would render any surrogacy agreement “void and unenforceable if the agreement is between a surrogate parent who is in the United States at the time of birth or who is a citizen or lawful permanent resident of the United States” and a foreign national or broker acting on behalf of a foreign national, unless the foreign national is legally married to an American citizen or lawful permanent resident.

 “These bills put children first (which should always be the case, and some seem to be forgetting that), and help prevent predators / foreign actors from obtaining children in our Nation for personal gain, profit, or other nefarious reasons,” Perry declared.

“Taken together, these bills signal a growing recognition that the current patchwork of surrogacy laws leaves too much ambiguity where clear safeguards should exist,” said the Center for Bioethics & Culture Network. “They also reflect broader bioethical concerns about domestic and international surrogacy markets, where commercial interests can outpace legal accountability and vulnerable parties, particularly children, can fall through regulatory cracks.”

The group added that it “had the pleasure of meeting Congressman Scott Perry in January 2026,” in a conversation that “reflected a shared understanding that U.S. surrogacy policy remains fragmented and in need of meaningful reform. His announcement today adds momentum to the work of educating policymakers and the public about the risks and realities of surrogacy, both in the United States and abroad.”

In March, U.S. Sens. Tom Cotton (R-AR) and Rick Scott (R-FL) called on the U.S. Justice Department to investigate the proliferation of Chinese-owned surrogacy labs throughout the United States.

The global children’s rights organization Them Before Us (TBU) provides a nationwide scorecard report for residents of every state to find out how well their home states prioritize children’s rights on multiple issues including surrogacy laws.
