Brazil’s Supreme Court Blocks Order for Ex-President Bolsonaro’s Early Release from Prison

Brazil’s Supreme Court Justice Alexandre de Moraes has blocked an order that would have greatly reduced the prison term of former President Jair Bolsonaro, who was given a sentence of 27 years for allegedly plotting a coup after the 2022 election.

The bill would have seen Bolsonaro released from prison in 2028, but Judge Moraes—one of the former President’s most powerful adversaries—blocked it.

Last month, Brazil’s Congress overturned a presidential veto of the bill, which passed Congress last year.

The bill would have cut Bolsonaro’s sentence to just two years.

Judge Moraes ruled the bill should not be implemented until the Supreme Court considers two pending cases to nullify it.

Bolsonaro’s lawyers have yet to make a formal request to reduce his prison term, but on Friday they filed a motion for a criminal review with the Supreme Court to overturn the sentence.

Bolsonaro began his 27 year, 3 month sentence under house arrest, but was moved into prison after he was alleged to have tampered with his ankle monitor.

While in prison, he has faced severe complications as a result of a stabbing that took place in 2018, during the election campaign. He has suffered pneumonia and other serious infections, and has been in and out of critical care.

In March, he was allowed 90 days of “humanitarian house arrest” because of his health.

Supporters of the former president have claimed his treatment is inhumane and a violation of his human rights.

His son Flavio Bolsonaro, a sitting senator, has described his father’s treatment as “playing with my father’s life” and “psychological torture.”
