Eleven families have filed a class-action lawsuit to prevent the Department of Justice (DoJ) from obtaining the medical records of transgender children.
The suit, filed by families whose transgender children received treatment at four hospitals, aims to prevent the DoJ from enforcing subpoenas sent to children’s hospitals across the US.
The subpoenas demand access to information related to children who have obtained so-called “gender-affirming care,” including diagnoses and treatment records.
The filing claims subpoenas have been sent to at least 20 hospitals nationwide.
The families and attorney say the Trump administration is attempting to “intimidate hospitals, frighten parents, and create what they describe as a de facto registry of transgender youth receiving medical care.”
“The Department of Justice has turned its investigative power into a weapon against families, and it has to stop,” GLAD Law Legal Director Josh Rovenger said in a statement shared with The Advocate.
“Federal courts have been clear: these subpoenas have no legitimate purpose, they are designed to harass and intimidate in order to further a political agenda.”
The filing came not long after a District Judge blocked investigations by the Federal Trade Commission into two transgender-advocacy organizations, the World Professional Association for Transgender Health and the Endocrine Society.
Judge James Boasberg, who is well known for his attempts to stifle the Trump administration’s deportation policies, said the administration had shown “extensive evidence of animus” and relied on “wafer-thin justifications lacking evidentiary support” in targeting the organizations.
The DoJ has said its investigations relate to healthcare fraud and legal violations connected to “gender-affirming treatment” for minors.
Since returning to power, President Trump has sought to reverse Biden-era policies on “gender-affirming care” and interpretations of civil-rights law that allow transgender participation in sports according to their chosen biological status and use of school restrooms and accommodation.
Executive Order 14187, “Protecting Children from Chemical and Surgical Mutilation,” was issued on 28 January 2025 and blocked federal support for gender-reassignment and hormone therapies for children. It also directed the Department of Health and Human Services to review available data on gender dysphoria and take “all appropriate actions” to halt “gender-affirming care.”
