An illegal alien unleashed into the U.S. by the Biden regime has been captured by federal authorities after sanctuary officials released him back into a Virginia community, despite charges for raping a pre-teen child.
The Department of Homeland Security (DHS) just released details about the apprehension of Walvin Victor Hugo Garcia, an adult male from Guatemala under a final order of removal.
Hugo Garcia was arrested in Fairfax County in June 2025 on felony charges of rape of a child less than 13 years of age, aggravated sexual battery of a victim under 13 years of age, use of a computer to commit sex offense with a minor, and distributing drugs to a minor.
Immigration and Customs Enforcement (ICE) lodged a detainer against Hugo Garcia, but he was allowed to walk free without ICE being notified following a recent appearance in Fairfax County Court.
ICE officers apprehended Hugo Garcia on May 1 and he remains in federal custody.
Hugo Garcia illegally entered the U.S. in 2023 near Eagle Pass, Texas, before being set loose in the interior of the country.
The Guatemalan was ordered deported by a federal immigration judge in February 2025, mere months before his arrest for the alleged rape.
Days after coming into office this year, Virginia Gov. Abigail Spanberger signed executive orders banning state cooperation with ICE and terminating 287(g) state and local agreements.
“Governor Spanberger and her fellow sanctuary politicians in Fairfax, Virginia refused to cooperate with ICE and RELEASED this child rapist from jail back onto the streets,” said DHS Acting Assistant Secretary Lauren Bis.
“This criminal illegal alien from Guatemala has been charged with raping a child under 13, aggravated sexual battery of a victim under 13, and distributing drugs to a minor. Thanks to our brave law enforcement, this sicko is out of our communities. Governor Spanberger and Fairfax sanctuary politicians are playing Russian roulette with American lives by releasing criminals from jail into American neighborhoods.”
