President Trump put Supreme Court Justices Amy Coney Barrett and Neil Gorsuch on blast in a long-social media post about their decision to strike down his “reciprocal” tariff policy.
“They were appointed by me, and yet have hurt our Country so badly! I do not believe they meant to do so, but their decision on Tariffs cost the United States 159 Billion Dollars that we have to pay back to enemies, and people, companies, and Countries, that have been ripping us off for years,” Trump wrote on Truth Social.
“It’s hardly believable!” he added.
The Supreme Court ruled in February, by 6-3, that President Trump’s use of the International Emergency Economic Power Act (IEEPA) to impose tariffs was wrong.
At the time of the ruling, President Trump said he was “ashamed” of certain justices, but didn’t mention them by name.
In his post on Sunday, he went much further, asking why the Supreme Court ruled the federal government would have to pay back the funds collected from the tariffs.
“I’m working so hard to, MAKE AMERICA GREAT AGAIN, and then people that I appointed have shown so little respect to our Country, and its people. What is the reason for this?” Trump wrote.
“They have to do the right thing, but it’s really OK for them to be loyal to the person that appointed them to ‘almost’ the highest position in the land, that is, a Justice of the United States Supreme Court.”
Trump ended the long post by warning the Supreme Court to rule in his favor on birthright citizenship, which he repealed by Executive Order. An initial hearing on the Order was held recently.
“Well, maybe Neil, and Amy, just had a really bad day, but our Country can only handle so many decisions of that magnitude before it breaks down, and cracks!!! Sometimes decisions have to be allowed to use Good, Strong, Common Sense as a guide,” Trump wrote.
“A negative ruling on Birthright Citizenship, on top of the recent Supreme Court Tariff catastrophe, is not Economically sustainable for the United States of America.”
On Friday, the Trump administration appealed the latest court ruling against the President’s tariffs.
The day before, the US Court of International Trade, in a 2-1 decision, found that President Trump’s 10% global tariffs, imposed in February, were not justified under the 1974 Trade Act.
The court ruled the Act was not intended to address trade deficits where the US imports more goods than it exports.
The ruling resulted in a block on the tariffs for three importers that sued the Trump administration: two small businesses and the State of Washington.
The tariffs are due to expire in two months anyway, but the ruling is yet another setback for President Trump’s flagship economic program.
As Reuters notes, “It also sets the stage for another protracted legal battle over billions of dollars’ worth of tariff refunds, three months after the U.S. Supreme Court struck down Trump’s sweeping global tariffs imposed under a national emergencies law.”
Speaking to reporters on Thursday, President Trump blamed the decision on “two radical left judges.”
US Trade Representative Jamieson Greer said the administration expects to win the case on appeal.
The new tariffs were only intended as a temporary measure.
The Trump administration is still planning to bring in a broader range of tariffs on its major trading partners using a third law, Section 301 of the 1974 Trade Act, which applies to “unfair trade practices.”
Three major investigations under Section 301 are due to be completed in July.
